1. Limited end user use

Talk Up A Storm™ administration grants you a non-exclusive, non-transferable, limited right to access and use free of charge the online lessons you subscribe to as a member of a "focus group", which is (the "Content) made available on the Talk Up A Storm™ website (the "Site"), provided that you agree to comply fully with this Agreement.  The content is only for your personal, noncommercial use. Your right to access the online lessons you subscribe to is for use by one individual only. Each additional user requires a separate subscription.

 

2. Provide Feedback Via Email

Users agree to submit written feedback via email regarding their experience as early adopters, teaching a series of Talk Up A Storm™ lessons to pupils.  Feedback may include, but not be limited to, whether the users, as teachers, enjoy using the program and are inspired by the Talk Up A Storm™ program, whether users as teachers find that their pupils are inspired and stimulated by the Talk Up A Storm™ program, whether users as teachers see progress in their pupils' verbal acquisition skills in English after using the Talk Up A Storm™ program.

3. Copyrights and trademarks

All materials on the Talk Up A Storm™ website including without limitation, text and images (collectively, the     "Materials") are owned or controlled by Talk Up A Storm™, which retains all rights, title and interest in and to the Materials. The Site and Materials are protected by the copyright and trademark laws of the USA and other countries, international conventions, and other applicable laws. You agree not to download, display, reproduce, create derivative works from, transmit, sell, distribute, or in any way exploit the Site or any portion thereof for any public or commercial use without the express written permission of Talk Up A Storm™.

4. Disclaimer and warranty

The site (including all content, materials, videos and information made available 

thereon or accessed by means thereof) are provided AS IS, without warranties of any kind, either expressed or implied, including, but not limited to, warranties of title or implied warranties of merchantability, fitness for a particular purpose, title, compatibility, security, accuracy, or non-infringement. To the fullest extent permissible by law, Talk Up A Storm™ makes no warranties and shall not be liable for the use of this site under any circumstances, including but not limited to negligence by Talk Up A Storm™.  Talk Up A Storm™ does not warrant that the functions contained in the site or the services will be uninterrupted or error-free, that defects will be corrected, that the site or services will meet any particular criteria of performance or quality, or that the site, including forums or the server(s) on which the site is operated, are free of viruses or other harmful components.

5. Limitation of Liability

Use of the site is at your own risk. You assume full responsibility and risk of loss resulting from your downloading, accessing or use of files, information, communications, content, or other material accessed through or obtained by means of the Site. Under no circumstances shall Talk Up A Storm™, or any provider of telecommunications or network services for Talk Up A Storm™, be liable for any indirect, punitive, special, or consequential damages that are directly or indirectly related to the use of, or the inability to use, the site, even if Talk Up A Storm™ or its' providers of telecommunications or network services has been advised of the possibility of the possibility of such damages. You release Talk Up A Storm™ and its affiliates from any and all obligations, liabilities, claims, incidental or consequential damages.

6. Single User

Each assigned user name for a Talk Up Storm™ online service is to be used solely by the individual to which it was issued.

7. Termination 

Talk Up A Storm™ reserves the right to restrict, suspend or terminate your access to Talk Up A Storm™ services, in whole or in part, with respect to any breach or suspended breach of any portion of this Agreement. Talk Up A Storm™ reserves the right to refuse to provide services to you in the future.

8. Cancellation policy

You may cancel your free subscription to Talk Up A Storm™ at any time for any reason whatsoever.

9. Privacy policy

We will keep users' personal information strictly confidential and not sell, rent, give distribute your personal information to any third party for marketing or any other purpose without your explicit consent.

10. Modification To This Agreement

Talk Up A Storm™ may modify this Agreement at any time and changes are effective as soon as the new agreement is posted to the site or a notice is made via electronic mail. If you are not satisfied with any such changes your only recourse and right is to cancel your subscription.
